1. Acceptance of Terms
By booking a diagnostic inspection, requesting chimney sweeping, scheduling masonry restoration, or authorizing flue liner installation with Absolute Chimney Pros ("Company", "we", "us"), the homeowner or authorized property representative ("Customer", "you") agrees to be bound by these Terms and Conditions. These terms supersede any prior oral representations.
2. Diagnostic Scope & Chimney Safety Standards
All evaluations, sweeps, and structural remediations performed by Absolute Chimney Pros adhere to professional chimney safety standards and the established practices of CSIA-certified technicians.
- Level 1 Inspections cover only readily accessible areas without the use of tools or internal camera probes.
- Level 2 Inspections include internal video camera examination of accessible flue passages, roofline clearances, and crawlspaces. Level 2 evaluations do not require invasive destruction of permanent drywall, masonry veneers, or framing unless separately authorized in writing.
- Condition reports reflect the observable physical state of the chimney system at the exact date and time of inspection.
3. Pricing & Written Estimates
Prior to the commencement of any repair or relining work exceeding initial diagnostic fees, the technician will present a detailed written scope of work specifying materials, labor, and total cost. No additional repairs will be performed without the homeowner's express verbal or electronic authorization. Written proposals remain guaranteed for thirty (30) calendar days from issuance.
4. Workmanship & Satisfaction Guarantee
We stand behind every service with our Satisfaction & Workmanship Guarantee:
- Stainless Steel Relining: Stainless steel liner installations are engineered and installed to system requirements and backed by our Satisfaction & Workmanship Guarantee, contingent upon regular annual inspections and maintenance.
- Masonry Restoration: Structural brick repointing, crown reconstruction, and refractory repairs are performed with quality materials and backed by our Workmanship Guarantee.
- Waterproofing: Chimney crown repairs and breathable water-repellent treatments are applied according to manufacturer guidelines to deliver durable weather protection.
5. Homeowner Site Access & Preparation
To ensure safety and prevent property damage during service:
- The fireplace must not be operated for a minimum of twenty-four (24) hours prior to the scheduled technician arrival to permit complete thermal dissipation.
- Clear physical access to the fireplace hearth, rooftop ladder points, and attic crawlspaces must be provided.
- Domestic pets must be safely secured in an adjoining room throughout the duration of service.
6. Payments, Deposits & Cancellations
Payment for standard inspection and sweeping services is due in full upon completion of the appointment. For custom masonry fabrication, chimney rebuilding, or high-capacity relining projects, a material deposit (typically 30% to 50%) may be required upon contract signing. We accept major credit cards, bank debit, and certified checks.
Cancellation Notice: We request at least twenty-four (24) hours notice for appointment rescheduling or cancellations to permit dispatch re-routing.
7. Limitation of Liability
Absolute Chimney Pros maintains comprehensive Commercial General Liability and Workers' Compensation coverage across all active operating jurisdictions. In no event shall Absolute Chimney Pros be liable for pre-existing concealed structural defects, water infiltration originating from defective roof shingles or siding unrelated to the chimney masonry, or failures caused by improper subsequent fuel burning (such as burning construction lumber, plastics, or accelerants).
8. Governing Law & State Licensure
These terms are governed by the laws of the State of New Jersey, without regard to conflicts of law principles. Any legal proceedings arising hereunder shall be filed within the competent courts of Ocean County, New Jersey.
